Here's an article stating that Conservatives on the bench are the activists in our midst:
We found that justices vary widely in their inclination to strike down Congressional laws. Justice Clarence Thomas, appointed by President George H. W. Bush, was the most inclined, voting to invalidate 65.63 percent of those laws; Justice Stephen Breyer, appointed by President Bill Clinton, was the least, voting to invalidate 28.13 percent. The tally for all the justices appears below.

Scalia 56.25 %
Rehnquist 46.88 %
O’Connor 46.77 %
Souter 42.19 %
Stevens 39.34 %
Ginsburg 39.06 %
Breyer 28.13 %One conclusion our data suggests is that those justices often considered more "liberal" - Justices Breyer, Ruth Bader Ginsburg, David Souter and John Paul Stevens - vote least frequently to overturn Congressional statutes, while those often labeled "conservative" vote more frequently to do so. At least by this measure (others are possible, of course), the latter group is the most activist.

I was goofin' on the term Hispanic, and how those republicans questioning Sotomayor might fail to see the difference.
That being said that distinction is ironic given that so many politicians and others of high-position routinely group us all as Anglos. I'm Pictish-Celtic.
Someone else with a name like Mihail Kazurinsky would be grouped the same.
Even worse is when on the forms they don't ask if you're white or Caucasian, they ask if you're a "White non-Hispanic."
Its only "activism" if they rule constitutionally on the side of the people.
If they rule in favor of the monied multinational corporation interests which screw 98% of the population, then they are not activists. Republican logic 101.

Lindsey Graham: As is always the story, the main character in this story is of course me. Impress me because well, I am what it's all about.

Several times since Judge Sotomayor was nominated, Lindsey has said if he had said what the judge did about being a wise latina he would have been finished. I always laugh when he says that. I guess if he had said that we was a wise woman he would be finished and he knows it.
Yes, that has been funny. He would probably be both: finished and out.
I wish he'd just spare us all the time-consuming drama, though, and ask her if he could borrow her shoes.
When I hear the name Lindsey Graham, the first thing that comes to my mind is "drama". The dude should have been a professional actor instead of a professional political actor.

Hoowever, Clinton was no liberal as depicted on the chart. He was a centrist at best. There hasn't been a liberal in charge for a LONG time. We just pick the person who stands to the left of Nixon and CALL them liberal.

Of COURSE the most "activist" judges are the right-wing nutjobs: they want to overturn any rulings that actually support civil rights.
It's no surprise that "Uncle Tom" Thomas is the worst; he'd just as soon take America back to the 19th century. With his boss Scalia's approval, of course.
What binds us is blind justice...unless you're not a rich white guy.
Sentor Sheldon Whitehouse just gave one hell of a great speech. It makes the whining republicans look like mere angry children looking to find a silly fight for the sole sake of fighting. If I were a republican yet to give my speech, I would just go home now.
Most normal people with a shred of dignity and 2 I.Q. points would.

1) "Conservatives" aren't really conservative;
2) John Paul Stevens, who has been on the court since Nixon, is what a true "moderate" should be--he has been in on a bazillion cases, but his tendency to overturn Congress is temperate.
Clarence Thomas, OTOH, is a waste of space. (OK, so that's three observations.)
